Why a SWMS alone isn’t enough

The documented system, not just the method

Every wastewater utility needs this pack, whatever its treatment plant does. The collection network is anaerobic by definition — sewers, rising mains, maintenance holes, wet wells and pump stations generate hydrogen sulphide and methane continuously, regardless of whether the plant downstream is aerated. And a SWMS alone does not discharge the duties. A SWMS is required for high risk construction work under section 299, and maintenance of these assets is construction work — but the SWMS only documents the method. It references the entry permit, the rescue plan and the gas detection regime; it is not any of them. Separately, the confined space duties in Part 4.3 apply to every entry whether or not it is construction work.

The gap, in one shift

Where holding only a SWMS goes wrong

A NSW council holds a confined space SWMS and believes it is covered. A crew attends a blocked maintenance hole in a main street. They have the SWMS. They do not have a permit system, so nobody formally verifies the upstream pump station is locked out. They have a four-gas detector, but it has not been bump tested for six weeks and its H2S sensor is near end of life, so it reads low — and they hold it at the opening, where it tells them nothing about the H2S pooled 4 m down or the methane at the crown. They set out cones rather than a traffic guidance scheme, because the SWMS describes an entry, not a road. One worker descends without a retrieval line, because the tripod is on another truck. Every one of those failures sits outside the SWMS and inside the four supporting documents this pack adds. The permit would have forced the isolation check and refused entry on an out-of-date instrument. The calibration procedure would have caught the sensor. The rescue plan would have stopped the descent. The council was not short a SWMS. It was short a system, and the gap is where people die.

Sewers, maintenance holes, wet wells, pump station chambers, valve pits, digesters and gas holders are all enclosed structures not intended for human occupancy, entered for maintenance with restricted entry and egress.

Anaerobic conditions generate hydrogen sulphide and methane continuously; biogas plant carries both at process concentration.

What the law requires

The work covered by this pack is high risk construction work under Section 291 of the WHS Regulation 2025 (NSW), so a SWMS must be prepared before work commences (Section 299), kept readily accessible, reviewed as necessary (Section 302), and given to the principal contractor if one is appointed. Critically, the confined space provisions in Part 4.3 apply in full and independently of construction status — an entry permit, atmospheric monitoring, a standby person and rescue arrangements established before entry are required for any confined space entry, including routine operational entry. Energised electrical work is separately prohibited under Part 4.7 Division 4, sections 154 and 157 unless de-energisation is not reasonably practicable. Hydrogen sulphide is a hazardous chemical and a PCBU must ensure no person is exposed above the workplace exposure standard, which in a wet well or chamber generally requires monitoring data rather than assumption. An H2S exposure, an asphyxiation, a biogas explosion, an electric shock, a confined space incident, a drowning or a traffic strike causing death or serious injury is prosecuted as a Category 1 or Category 2 offence under the WHS Act 2011 (NSW), with the most serious breaches carrying imprisonment for individuals, and the duty of care extends to members of the public near an open chamber in a road reserve.

The confined spaces and hazardous chemicals Codes of Practice are the benchmark a regulator will measure this work against, with AS 2865 for the entry system, AS 1742.3 for the traffic guidance scheme and the AS/NZS 60079 series where biogas creates a hazardous area.

01Match the SWMS to the method, not the asset: entering a space, working on pump station equipment, or non-entry network and gas plant work are three different documents.
02Issue a confined space entry permit for every entry — one permit, one shift, one described task — verifying isolation, then testing, then ventilating, then re-testing before issue.
03Test at the top, middle and base of every space with a sample line — methane collects at the crown while H2S and CO2 pool at the base, so one reading clears neither.
04Never rely on odour: H2S deadens the sense of smell at roughly 100-150 ppm, so the smell disappearing signals greater danger, not less.
05Establish non-entry rescue before entry — tripod or davit, winch and retrieval line rigged, entrant harnessed, standby person outside, and never an unprotected entry to rescue.
06Bump test every gas detector before each day's use, calibrate to the manufacturer's instructions, tag out any failure, and track H2S sensor age as well as calibration date.
07Never enter a digester or biogas structure on a wet-well procedure — de-gas, purge, verify, use Ex-rated equipment and enter only under a higher-order controlled entry.
08Isolate and lock out every drive and circuit before work — pumps, mixers, impellers, aerators, scrapers, screens and augers — including automatic and remote/SCADA start, verified physically.
09De-energise and prove dead before electrical work; energised electrical work is prohibited under Part 4.7 Division 4, sections 154 and 157 unless de-energisation is not reasonably practicable.
10Depressurise and isolate the rising main before breaking any connection, and guard the open wet well before any lift begins.
11Install a traffic guidance scheme to AS 1742.3 before a cover is lifted in a live carriageway, so the entrant, standby and rescue set-up all sit inside protected space.
12Establish where exposure actually sits by personal monitoring — target rising main discharge points, wet wells, maintenance holes downstream of a rising main, and inlet works.
13Ensure workers hold a current White Card (CPCCWHS1001) where on a construction site, plus confined space, standby, permit issuer, gas detection, jetting, traffic and electrical competencies, and drill the rescue plan on the actual assets.
14Consult workers per Section 47 of the WHS Act 2011 (NSW), record it, and review every document whenever assets, method, personnel or exposure standards change, after any incident, or at minimum every 12 months.
